According to the Bulgarian legislation, all foreign investors having bought property in Bulgaria in their capacity of legal entities, can be supplied with accountancy and administrative services through the companies registered on them in order to strictly keep all laws of the Republic of Bulgaria.
The Bulgarian laws do not let foreign investors to own their own property on the territory of the country as physical persons. This, however, does not concern legal entities with foreign participation, established by the Bulgarian legislation. For that reason, in order to carry out their intention to purchase a property in Bulgaria most investors register a company. Owning a company in our country is a complicated and difficult process. Difficult because it is necessary to possess substantial, profound knowledge on the currently operating Bulgarian legislation and at the same time complicated because the laws concerning the accounting and tax policy of our country have to be strictly observed. The sanctions imposed for failure of or delay in their observing are very strong and are always accompanied by tax checkup of your company regardless of the fact that it can be kept open with taking into account the sole purpose of purchasing a property and even it may not be actively functioning.
According to our Accounting legislation, each registered company is obliged to present annual balance by preparing annual tax report, which along with the tax declaration should be presented in front of the local Tax Office not later than 31 March each year. The penalty for failing to declare as well as for drawing up a document with untruthful content is imposing a fine which starts from 2000 BGN( about 1000 EUR).
If the overall accountancy servicing of your company has not been accurately kept or the time terms have not been observed, your company will have to pay considerable fines, assuming the whole stringency of the Bulgarian laws and can expect audit inspection. Insurance of real estates and tenants
Covered Risks and Exclusions under Home and Contents Insurance
The Insured is insured for loss or damage to his/her Home and Contents caused during the Insurance Coverage Period directly by any of the following insured events
(1) Fire or Explosion, but not loss or damage to any item caused by scorching, melting, or charring without flames;
(2) Storm (including cylclone or hurricane) and/or rain, which may be accompanied by snow, sleet or hail, but not loss or damage caused by:
(2a) mildew, mould and other microorganisms ;
(2b) atmospheric or climatic conditions other than storm;
(2c) water entering the property through an opening made for the purpose of alterations, additions, renovations and repair;
(2d) water seeping into the Home through a wall, ceiling, roof or floor;
(3) Lightning or thunderbolt, but not loss or damage caused by fluctuations in the power supply, unless there is evidence that the damage was caused by a direct lightning strike;
(4) Earthquake, provided:
(4a) all destruction or damage occurring within a period of 48 hours of the earthquake is regarded as the one insured event;
(4b) the amount of the due indemnity shall be reduced with 3% of the sum insured of the Home and/or Contents;
(5) Flood (inundation of normally dry land by water from any watercourse, lake, canal, dam or reservoir), provided the amount of the due indemnity shall be reduced with 3% of the sum insured of the Home and/or Contents;
(6) Theft of electronic appliances by forcible and violent means, but not more than Euro 1000 for one occurrence and in aggregate for one Insurance Coverage Period;
(7) Malicious acts, but not loss or damage intentionally caused by the Insured, a member of the Insured's family, a direct or lateral relative of the Insured, a tenant of, or visitors of a tenant of, the Home, but not more than Euro 5000 for one occurrence and in aggregate for one Insurance Coverage Period;
(8) Bursting or leaking of fixed pipes used to hold or carry liquid of any kind, but not loss or damage which occurs gradually over time, provided the Insurer shall not pay:
(8a) for repair or replacement of the apparatus, tank or pipe itself;
(8b) provided the amount of the due indemnity shall be reduced with 100 euro .
(9) Impact by:
(9a) a vehicle, an aircraft or a waterborne craft;
(9b) space debris or debris from an aircraft, rocket or satellite;
(9c) an animal;
(9d) a falling tree or part of a tree;
(9e) a mast or a television or radio aerial that has broken or collapsed;
but not loss or damage caused by:
- an animal kept in the Home;
- rodents, vermin, or moth

New construction
If you own a land plot and want to have your own home built, then you are the investor funding the building up of this home. You should be aware of the fact that the planning of territories of the municipalities is carried out by the Local Council and Mayors according to Territories Planning Law (TPL) of 2002. TPL defines building up as laying, erection and construction of buildings, premises, networks and equipment on the land plots.
The chief architect of the municipality is authorized to control these activities.
The first things you will need are:
A. A sketch/visa to design, requested in writing by the person who has the right to build on their land property. With this application filed, the chief architect of the municipality then issues a visa to design within 14 days of date of application filed. The visa to design is an identical copy of the current Detailed Town and Country Plan (DTCP) where layout, method of building, intended purpose of use, size, measurements, and distances of the project building are designated. It also states a number of requirements to be met, such as architectural and territorial, environmental, infrastructure, water and electric supply and other resources, as well as the complete set of papers, which the investor must file.
B. A shop-drawing which may be drawn by the construction company or another designer team. It has to include the architectural part along with structural, electrical, water supply and sewerage, and heating and ventilation parts. Each part must be accompanied with explanatory notes, drawings, and calculations.
C. Approval of the shop-drawing is given by the chief architect of the municipality. His task is to approve the architectural part, following prior approval of the other parts by experts of the municipality. Other authorized bodies review the compliance of the project building with regulations and standards related to:
- environmental restrictions enforceable on buildings;
- sanitary control;
- fire and accident hazards;
- technical safety and reliability of potentially hazardous equipment;
- landslide restrictions;
- and restrictions on certain kinds of buildings.
Approval or refusal is given within one month from date of submission. Pursuant to the Government Taxes Law and Local Taxes Law, the authorized bodies engaged in the review and approval collect taxes.
When the set of papers has been completed with:
- ownership deed,
- visa to design,
- approved shop-drawing in 3 copies,
- and all other binding permits issued by the specialized bodies,
then the next step is to file
D. An application for building (planning) permission
This permission is issued within 7 days from the date the application is filed and it states all factual and legal grounds for the permission to be granted, as well as terms and conditions for the execution of construction. The permission issued or refusal to issue permission may be appealed against within 14 days from the date of issue of the corresponding act.
The permission to build is considered null and void, if construction has not started within 3 years from date of permission issuance, or if the rough structure construction, roof inclusive, has not been completed within 5 years from date of issue of permission.
The next stage is:
E. Commencement of construction. Building work actually begins with the drawing up of the Protocol, which permits opening of the building site along with the building line and level. To have such a protocol signed, investors need to file an application with the Mayor’s Office. The main participants in the building process are the investor, the designer, and the builder, and they may freely enter contractual relationships abiding the law. Contracts should provide for legal obligations considering terms of time, quantity and quality of construction, assembly, erection, and mounting works to be done by the builder in conformity with the building code and norms. When the building has been finally completed, the investor and the builder draft a
F. Findings statement in which they certify that all building works have been executed in accordance with all approved plans, drawings, technical prescriptions, and contractual provisions. This statement is the actual conveyance of the building from the builder to the investor.

Organization of payments
With the property management Contract, our company can be tasked with the responsibility for all kinds of payments pertaining to the property and company of the owner according to their wishes.
Our specialists can remit to the owner all receipts by bank transfer to either a Bulgarian bank or foreign bank account. Together with the owner of the premises, our company will agree on the rate of rent for both brief tenancy (from 1 up to 29 nights), or longer tenancy (29 and more nights). With longer tenancy, 50% of the first month rent will be collected in advance.
At any time, the property manager will keep the owner informed for current, previous and future bookings, expenditures made, collected rent receipts as well as any other important circumstances related to the premises by rendering to the owner weekly or monthly statements and reports.
Acting as the agent for the owner, we will pay bills for electricity, water supply and sewerage, telephone, cable TV, and Internet, cleaning, maintenance, and security.
